By accessing or using Acqivest ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Service. These Terms form a binding agreement between you and Acqivest Inc. ("Acqivest", "we", "us").
You must be at least 18 years old and capable of forming a binding contract to use the Service. By registering, you represent that the information you provide is accurate, complete, and current. You are responsible for all activity under your account.
Acqivest is a business acquisition platform connecting qualified buyers with sellers of small-to-medium businesses ($500K–$5M typical). The Service includes business listings, DealScore SBA pre-qualification, NDA and deal-room workflow, the Three Tools (Valuation, Credit Risk, Exit Readiness), a Partner Network directory, and AI-assisted coaching ("River AI"). The Service does NOT provide legal, tax, accounting, or licensed financial advice.
You agree NOT to: (a) impersonate any person or entity; (b) misrepresent financial information or DealScore inputs; (c) attempt to circumvent NDA gating or PII-masking controls; (d) use automated tools to scrape listings or member data; (e) bypass paywalls or promo-code controls fraudulently; (f) post unlawful, infringing, or fraudulent content; (g) interfere with the integrity of the Service or other users.
Acqivest operates on a success-fee model — we earn primarily when a transaction closes. Specific paid features (Three Tools detailed reports, Premium Lender Portal, Partner Network premium placement) are billed at the rates published on the Service at the time of purchase. Promo codes provided by Acqivest may be revoked at any time.
Information provided through the Service, including valuation ranges, credit risk assessments, exit readiness scores, and any River AI responses, is FOR INFORMATIONAL PURPOSES ONLY. It is not legal, tax, accounting, financial, or investment advice. Always consult licensed professionals before making transactional decisions. Acqivest is not a registered broker-dealer, investment advisor, or law firm.
Listings are submitted by sellers or aggregated from third-party sources. Acqivest verifies revenue for sellers who opt into our Verified Revenue program but does NOT independently audit every listing. Buyers are responsible for their own due diligence. You acknowledge that business acquisitions carry substantial financial, legal, and operational risk.
The Service, including all code, designs, content, and trademarks (including "Acqivest", "DealScore", "CompIndex"), is owned by Acqivest Inc. and is protected by intellectual property law. You receive a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.
We may suspend or terminate your account at any time, with or without notice, for any breach of these Terms or for any conduct we determine, in our sole discretion, to be harmful to other users, third parties, or our business. You may close your account at any time by emailing support@acqivest.co.
To the maximum extent permitted by law, Acqivest will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, goodwill, or data, arising out of or related to your use of the Service. Total liability for any claim is capped at the greater of $100 or the fees you paid Acqivest in the 12 months preceding the claim.
You agree to defend, indemnify, and hold harmless Acqivest, its officers, directors, employees, and partners from any claims, damages, liabilities, or expenses (including attorney fees) arising from your breach of these Terms or your misuse of the Service.
These Terms are governed by the laws of the State of [Legal Team to fill in], without regard to conflict-of-laws principles. Any dispute will be resolved exclusively in the state or federal courts located in [Legal Team to fill in]. You waive any right to a jury trial or to participate in a class action.
We may update these Terms at any time. Material changes will be communicated via email and/or a prominent banner on the Service. Continued use of the Service after the change date constitutes acceptance.
